These Just Jolly Reviews Terms of Service ("Reviews Terms of Service") set forth the terms and conditions governing your use of the review functionality ("Reviews") provided by Just Jolly, a social networking platform powered by Incomars Software Services ("Just Jolly", "we", "our", "us"). By submitting, posting, or otherwise interacting with Reviews on the Platform, you ("User", "you", "your") expressly acknowledge and agree to be bound by these Reviews Terms of Service, as well as the Just Jolly Terms of Service and Just Jolly Privacy Policy (collectively referred to as the "Terms"). You further agree that any engagement with the review and rating system signifies your unequivocal consent to these Terms, including any future amendments made in accordance with applicable law. If you fail to comply with any provision contained herein, Just Jolly reserves the right, at its sole discretion, to remove or reject your Review, suspend or terminate your access to the review functionalities, or take any other remedial action deemed necessary.

1. DEFINITIONS:

1.1 Reviews: User-generated content, including but not limited to written feedback, comments, opinions, and ratings, including star ratings from 1 to 5, regarding the User's experience with the Platform and its features.

1.2 Platform: The social networking platform operated by Just Jolly and powered by Incomars Software Services, which facilitates user interaction, communication, and the submission of Reviews.

1.3 Review Content: Any text, feedback, commentary, rating, or other submissions shared by users through the Platform’s review system.

2. ELIGIBILITY AND ACCEPTANCE:

2.1 To submit a Review, Users must be registered and in good standing on the Platform.

2.2 By submitting a Review, you affirm that: (a) The Review constitutes your honest and unbiased opinion of the Platform, based solely on your personal experience; (b) You are the sole author of the Review and possess the full legal rights to share such content; (c) The Review complies with all applicable laws, rules, regulations, and these Reviews Terms of Service.

2.3 Users acknowledge and agree that Just Jolly, at its sole discretion, reserves the right to reject, remove, or modify any Review that it deems inappropriate, irrelevant, or in violation of these Reviews Terms of Service or any applicable laws.

3. ACCEPTABLE USE OF REVIEWS:

3.1 Reviews must be factual, respectful, and relevant to the use of the Platform and its features. You are prohibited from submitting Reviews that: (a) Contain abusive, defamatory, or offensive language, including but not limited to hate speech, discriminatory comments, or threats of violence; (b) Are vulgar, obscene, sexually explicit, or pornographic in nature; (c) Promote illegal activities or materials, including but not limited to drugs, violence, terrorism, or any unlawful conduct; (d) Engage in harassment, bullying, or the incitement of harm against individuals, groups, or entities; (e) Contain false, misleading, or malicious statements that could potentially harm the reputation or business operations of Just Jolly or any third parties; (f) Violate the intellectual property rights, privacy rights, or any other legal rights of third parties.

3.2 Users are prohibited from submitting Reviews that contain hyperlinks, spam, or any other form of unsolicited promotional content.

4. RATING SYSTEM:

4.1 Users are provided the ability to rate the Platform on a scale of 1 to 5 stars based on their personal experience with the Platform and its services.

4.2 Users are prohibited from artificially inflating their ratings through any fraudulent means, including but not limited to submitting false reviews, creating multiple accounts to affect ratings, or coercing others to provide specific ratings.

5. REPORTING OF INAPPROPRIATE REVIEWS:

5.1 If a User encounters a Review that they believe violates these Reviews Terms of Service or is otherwise offensive, unlawful, or inappropriate, the User may report the Review to Just Jolly by following the reporting procedure established within the Platform.

5.2 Upon receipt of a report, Just Jolly shall review the flagged Review and, at its sole discretion, may: (a) Remove or modify the Review if it is found to be in violation of these Reviews Terms of Service or the law; (b) Take appropriate action, including suspension or termination of the User’s account if the User is found to have engaged in fraudulent or abusive activity related to the Review.

6. INTELLECTUAL PROPERTY RIGHTS:

6.1 You retain all rights to the content of your Review, subject to the license granted to Just Jolly in this section.

6.2 By submitting a Review, you grant Just Jolly an irrevocable, perpetual, non-exclusive, royalty-free, and fully sublicensable license to use, reproduce, modify, distribute, display, and otherwise exploit the content of your Review in any form, format, or media now known or hereafter developed, solely for the purposes of promoting or improving the Platform, including for marketing and advertising purposes.

6.3 Just Jolly’s trademarks, logos, and other proprietary content related to the Platform remain the exclusive property of Just Jolly or its licensors. You may not use these trademarks, logos, or proprietary content without prior written consent.

7. LIMITATION OF LIABILITY:

7.1 To the maximum extent permitted by applicable law, Just Jolly shall not be held liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of the review functionalities, including damages resulting from inaccurate or offensive Reviews.

7.2 Just Jolly’s total liability in connection with these Reviews Terms of Service shall not exceed the amount, if any, paid by you in connection with the use of the review functionalities.

8. INDEMNITY:

8.1 You agree to indemnify, defend, and hold harmless Just Jolly, Incomars Software Services, and their respective officers, directors, employees, agents, affiliates, and licensors from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or in connection with: (a) Your violation of these Reviews Terms of Service; (b) Your submission of a Review that infringes upon the rights of any third party; (c) Any unlawful or fraudulent activity related to the review and rating system.

9. GOVERNING LAW AND DISPUTE RESOLUTION:

9.1 These Reviews Terms of Service shall be governed by and construed in accordance with the laws of India.

9.2 Any disputes arising from or relating to these Reviews Terms of Service shall be subject to the exclusive jurisdiction of the courts in New Delhi, India.

9.3 Notwithstanding the foregoing, any disputes or claims arising out of or in connection with these Reviews Terms of Service shall first be attempted to be resolved through amicable negotiations between the parties. If such disputes cannot be resolved through negotiation, they shall be referred to binding arbitration in accordance with the provisions of the Indian Arbitration and Conciliation Act, 1996, with the place of arbitration being New Delhi, India.

10. AMENDMENTS AND MODIFICATIONS:

10.1 Just Jolly reserves the right, at its sole discretion, to modify, amend, or update these Reviews Terms of Service at any time. Any such modifications or amendments will be posted on the Platform, and the effective date of the modified Terms will be updated accordingly.

10.2 By continuing to use the review functionalities after any modifications or amendments, you acknowledge and agree to be bound by the updated Terms.

11. CONSENT AND ACCEPTANCE:

By agreeing to these Just Jolly Reviews Terms of Service, you further acknowledge and agree that you are also accepting the Just Jolly Terms of Service and Just Jolly Privacy Policy, which together govern your use of the Platform, including the submission and management of Reviews.
