Branded content is defined as content created by a publisher or creator that features or is influenced by a business partner in exchange for value. This includes when you post content that features a product or service that was gifted to you or provided in exchange for a post. Below is a guide outlining common use cases for branded content and whether a tag is required.

Payment from a brand or business partner in exchange for posting content constitutes an exchange of value, so a branded content label is required.

A brand or business sends you gifts or free products or services, and you post content that features or mentions those products or services 


Examples: A company sends you a free product and you post a photo showing you wearing that product. A company lends you a free product and you post a photo showing you using that product.

Yes

Posts featuring a free or loaned product or gift from a brand or business partner also constitute an exchange of value, so a branded content label is required.

You post content that promotes your own products 


Example: You post content about your own makeup or bag line.

There is no brand or business partner involved here, so it is not considered branded content. However, you are still responsible for complying with all relevant legal obligations, including any disclosure requirements you may have.
